Soted it, if anyone eles is stuck, the general idea is to wait a in-game week and go to the gun shop between 10pm and 2am.

I was having the same problem, ugh wait a week, so many saves, grr.

all i did was save my game shut off the console and start it back up the next day and he was there so you might try that so you dont have to waste all that time... but obviously not wait till the next day like i did i just did that cuz i was done playing for the night
