:mad: My xbox has just died on me with the red ring of death, an hour after Forza 2 as well. The thing is i'm out of warranty and i was wondering if i will be able to get this repaired, with or without a price tag? This is the first problem i've ever had for a year and 7 months. :mad:

Call 1800 4MY XBOX and tell them that you had no idea it was out of warranty and just generally BS them. They know they released a faulty product and will usually repair them for free. If you get an agent that's just being a jerk ask to speak to his/her supervisor and let them know how loyal your are toward there product line and throw in that the unit has cost you alot of money, not only the console but all the scratched games you have had to re-buy because of their faulty DVD-ROM. You are the customer, so let them know that and if it means lying and getting a little mean do it. They're a billion dollar company I think they can afford it. If you need help on what to say, send me a fr and I will help you out. They have fix my machines 6 times when then warranty was out; for free.

Just be firm, but polite at the same time. As soon as they tell you you'll have to pay, let them know your not happy about it.

Pull the my parents are pissed and want to speak to the head supervisor card...also let them know they didn't remind you of your warranty's impending expiration and since you did not buy it you did not know....Be aggressive but not overly so and be polite but not in a kiddie way if you know what I mean.

Since all Xbox warranty's were changed I believe they will repair it for free with out much hassle.

A m8 of mine had a 360 from launch day die on him on tuesday, he knew it was out of warrenty and he did as said above and they are collecting his 360 and sending him a new one out free of charge. I hope they do the same for you m8, as we all know a multi billionaire company can afford 1 free xbox360. Good Luck buddy.
Nats because your in the UK you have an action against your retailer because of the beauty that is the "Sale of Goods Act 1979", s14 I believe. Just speak to the retailer and mention that, then say that under said section it states the item must be durable. Then say Consumer Direct advised you and they won't say a word ;)

Thanks for all your replies. Unfortunatley i tried before Webb replied to me and i never managed to say what he said. Basically she wouldn't accept what i was saying blah blah, but i never agreed for her to pick up my xbox. She gave me a reference number but i will ring back with you advice you gave me Webb. Can you explain in more detail what this is so i can back myself up mate. Thanks for the positive replies. :)
Ahhh, it doesn't matter whether you mentioned it to MS because after a year you have no "manufacturer's rights". But under UK law you have an action against the retailer, i.e. the shop where you bought it from. I had the same problem, but the retailer I bought it from had gone bust so had no action, thats where you should be alright though.

HMV, say you've spoke to consumer direct and they say that under s14 the goods you purchased must be of a satisfactory quality which includes durability...
Relevant sections are (you may want to print off and point it out to them ;)):
Section 14 (2) Where the seller sells goods in the course of a business, there is an implied term that the goods supplied under the contract are of satisfactory quality. (2B) For the purposes of this Act, the quality of goods includes their state and condition and the following (among others) are in appropriate cases aspects of the quality of goods—
(a) fitness for all the purposes for which goods of the kind in question are commonly supplied,
(b) appearance and finish,
(c) freedom from minor defects,
(d) safety, and
(e) durability.:D
What that basically means is that you have a remedy free of charge. And this is accurate info from a law student, so it's not just someone claiming the world :p

Webb that's awesome, my dad's a former US Attorney, DA, ADA, was in JAG so on and so forth, he wanted me to go into law but I found it a bit tedious. Lately I have been thinking about going into corporate law, that's the only field that really appeals to me, if the business venture I am starting up falls through for some reason I will have it to fall back on....anyways I'm interested to hear where you are in law school at, if you don't mind me asking?

I'd say yes just so you don't get caught in a lie, tell them MS told you about the law or something of that nature. But I wouldn't start off by telling them that, just throw the law right at the retailers face right from the start, I don't think they will be asking to many questions about MS... but be prepared either way as MS does have your reference number but then again if you tell them there was no need to contact MS because you knew of the law, that could also work in your favor. It's just what you feel more comfortable with, but remember to show them the laws in the beginning not when your half way out the door... Good luck again!

being a manager in retail - your custom is of the upmost importance so straight away ask to speak to the member in charge (we hate complaints and upset customers). because its out of warranty hmv would not get credit from microsoft for the broken machine and because ms set the warranty not hmv, they could tell you to phone ms. if they give you trouble best thing to do is phone trading standards as they can tell you the best action to take

Good luck again! Thanks alot for all of this :) I'm basically gonna tell them about the law pratically straight away after i've explained about my 360 and so on. If they ask questions and give sensible answer which will favour me, if i can.
@ TG3 HAVOK, thanks for the advice. So if it doesn't go to plan, which now there is a different side of things coming from a retail manager, i shall ring Trading Standards and ask for advice like you say.

Yeah, pretty much. Nats would be better speaking to "Consumer Direct" if HMV become dicks about it. Refusal is a breach of your statutory rights ;)

you shouldnt really have any problems as every company who sell xbox 360s know of its hardware issues and the fact that they were not fit for purpose (ie - not durable like webb said). I do belive that hmv can pull a reciept off their system from a couple of months ago so microsoft will think its in warranty and credit the store. I do it al the time. At the end of the day customer is always right ;) (and microsoft can afford to loose a couple of quid)

Well i have a few routes to go down now and hopefully one of them work. Like you say HMV will know of the hardware issues and i shouldn't have a problem. But, if i do have a problem i can always speak to Trading Standards or Consumer Direct. Hopefully i will be going to HMV tomorrow to try and sort this out. I'll try and keep you up to date as it happens. Thanks again! :)

Right, bad news guys. My Dad rang Microsoft this evening and said the advice you gave. Which we had no joy because a Spanish woman didn't understand and kept going on about the warranty. :mad: So basically my Dad was talking about the s14 and the sales of goods act and so on. No joy again. We took a trip to HMV and again... no joy. The manager was saying that after the warranty had ran out its not their problem. My Dad fought it by got nowhere as the Manager wasn't taking any of it. Although, when my Dad mentioned Trading Standards he did say that may be able to help us, but we'll have to try them tomorrow now. Anyway, looks like we'll be paying th £85 to get it repaired.

i know you've sent it away now but what you should have done is claim on your contents insurance for your house saying you dropped it, knocked it, spilt something on it etc. your excess on your insurance is prob £50 or less and you would get a brand new xbox with warranty. instead now you've paid £85 and all microsoft will do is send you a refurbished xbox with limited/no warranty.
it really sucks about all the hassle you've had i'm just waiting for it to be my turn for my xbox to break then ill def be using all the info you guys have given.

Let me just say something here. Everyone I know at my school who got it previous to 2007 has had their xbox break on them (mine broke in Dec which means it lasted 11 months). Mircosoft's Xbox 360 apparently is not a quality product, and with all the calls mircosoft must get each and every day, why don't they improve the warrenty or the quality by now? Also, I wouldn't mind if it was a quick process to get it back from their location in Texas but it takes 4 weeks, and in those 4 weeks you are suffering from the following syptoms:
- Lack of Gears of War
- Achievement Withdrawl
- A strange urge to yell at little kids on xbl
so.... may your xbox's have good health
